In normally balmy Florida, this year's frigid arctic blast didn't stop Federal District Judge Roger Vinson from ruling ObamaCare unconstitutional.
That now makes two federal courts that have ruled this legislation a gross overreach of federal power. In all, 26 state Attorneys General have filed lawsuits to erase the destructive HealthCare Act.
But that didn't stop every Senate Democrat from voting against Minority Leader Mitch McConnell's repeal bill yesterday. In a straight party vote, 51 Democratic Senators offered a colder shoulder to the American people than this winter itself. It is government arrogance on full display and without apology.
It's not over. In fact, we're just getting started. Even deaf Senators will hear us when, together, we produce a full throated roar that this law WILL be repealed.
We're not going to wait two years for the U.S. Supreme Court, which may rule to repeal. We're not going to watch the federal budget (and our healthcare and pocketbooks) further damaged as China buys up more and more of our debt. We must do what needs to be done -- force Senate Democrats to vote for repeal.
Can it be done? Yes.
We faithfully delivered more than half a million of your petitions to an already willing House of Representatives ...."

U.S. Senate to Vote on Repeal of Healthcare Reform Law Today!
The U.S. Senate will vote today on a Senate resolution to repeal the Healthcare Reform law. The resolution was introduced by Senate Minority Leader, Mitch McConnell, R-Ky. A total of 67 votes are needed in order to override a presidential veto.

I live in a predominately Democratic state now ... a big change from the Texas that I am used to, but you can be certain that I will be out in force campainging against the two senators in this state when they are up for re-election. Unfortunately, Pat Murray just won re-election here somehow? So she will be sitting comfortably in her Senate seat for awhile ... but I will keep writing to her in the meantime, as the need arises.
I am now hopeful that this case will be fast-tracked to the Supreme Court ... I have heard via the news and reading on the internet that several state Governers are already planning to declare this law void in their repsective states based on the Pensecola, Florida ruling of Judge Roger Vinson a few days ago.

U.S. Judge, in Pensecola, Florida Rules Healthcare law is Unconstitutional
A U.S. Judge, in Pensecola, Florida has ruled this morning ... in repsonse to a lawsuit filed by the Attorney Generals of 26 U.S. States ... that the Healthcare Reform law as passed by the 111th Congress is unconstitutional. This is the second U.S. Judge to rule that the law was unconstitutional, but the first judge to rule that the entire law was unconstitutional. A Virginia judge had previously ruled that the "individual mandate" only was unconstitutional.
In his written ruling, Judge Roger Vinson, stated that the "individual mandate" requiring all individuals to purchase health insuarnce was unconstitutional. He further stated that because this portion of the law was not "severable from the whole", that the "law in its entirety is therefore void."
This is a huge victory for justice, but unfortunately a final judicial say in the matter will not come until this case and likely dozens of others like it finally make their way up to the U.S. Supreme Court which could take up to 4 years. In the meantime, while awaiting appeal at the highest level, this Healthcare Reform law will go into effect and begin the socialization of our U.S. Healthcare System.* Thus, the need to act still remains. We must stop this law now at the Congressional level. The time to act is now!
I urge you to write to your U.S. Senators (you have 2) and urge them to vote against this unconstitutional Healthcare Reform law. Remind them that they represent you ... us ..."We the people" and that WE want this bad and unconstitutional piece of legislation repealed NOW! Let them know that we will hold them accountable for their actions. If they voted for this law under the 111th Congress, now is the chance for them to redeem themselves. Then urge your senator to take the worthy measures in the law up under separate, constitutional, legislation (e.g., no pre-existing condition clauses, malpractice lawsuit reform, requirement for insurance companies to spend at least 85% of their premium intakes on actual healthcare costs).

*The "individual mandate" portion of the Healthcare law will not go into effect until 2014, hence the reason that Judge Vinson did not issue a separate ruling to prevent Congress from enacting other portions of this law. I guess, that the Judge is relying upon the notion that the appeal in this matter will reach the U.S. Supreme Court level before the "individual mandate" portion of the law goes into effect.

Repeal Healthcare Reform Law Update ...
I have previously discussed (in many, many posts) the specific reasons why I feel this piece of legislation is so so very BAD for our country. For this reason, lately I haven't felt the need to restate the same points over and over again. That being said, I got to thinking that maybe someone who is uninformed or undecided might be persuaded to action if I wrote a brief summary once again. So here goes ...
The first and foremost reason for repeal, is the fact that this piece of legislation will ultimately result in the socialization of our healthcare system ... and if you don't know what that means just look at the failed healthcare systems in Europe (e.g., the United Kingdom ... England). It means a lower quality of overall care due to government over-regulation. It means longer wait times for needed treatments and in a worse case scenario the government deciding who gets what treatments and when. I don't know about you, but the latter scares the HELL out of me!!
The second compelling reason for repeal is that overall costs will rise for people like you and me as the insurance companies pass the burden of government increased coverage requirements onto the little guy. A third compelling reason for repeal of the Healthcare Reform law is that some small businesses, not lucky to have won a government "Get Out of Jail" free card, will go bankrupt trying to meet the new government mandates for providing health insurance for all of their employees. Ironically, in many cases paying the penalties for not insuring all employees will actually be cheaper than conforming to the new healthcare coverage mandates in the Healthcare Reform law.
If you're worried about the "pre-exisitng" conditons clause that many insurance companies currently hide behind in order to deny coverage: this issue can and should be addressed in an entirely separate piece of legislation. Same thing goes for addressing sky-rockecting malpractice insurance costs. This should also be addressed in a separate piece of legislation. We shouldn't have to swallow this entire poisonous pill of a piece of legislation in order to address these issues. The latter issues are just camoflauge for the greater end goal of socializing the healthcare system in our country.
And a third reason to vote for a repeal of the Healthcare law: this law is unconstitutional. The Congress has overstepped its powers, as given by the U.S. Constitution, by requiring that all individuals must purchase some form of healthcare insurance.
Now is the time to ACT ... do something positive. Write to your Senators in the U.S. Congress and tell them that you DON'T WANT THIS PIECE OF HEALTHCARE LEGISLATION. Tell them that you WILL HOLD THEM ACCOUNTABLE and THAT YOU EXPECT THEM TO VOTE FOR A REPEAL OF THE HEALTHCARE REFORM LAW. Then go to the website listed at the top of my page and in the link given below and SIGN THE PETITION (which will be delivered to the U.S. Senate) to have the Healthcare Reform Law repealed. And be sure to pass this message onto all of your friends and family: Together we CAN make a difference!!

Vowing to obey the will of the people, new Members of the House of Representatives promise a vote to repeal the HealthCare Act on January 12th. Your Repeal It Now campaign has been asked to begin delivery of petitions the day before this historic vote.
“We will be bringing 500,000 petitions to the steps of the Capitol. Our petitions will include the names and hometowns of all of those who have joined our massive petition drive,” said Ken Hoagland, chairman of the campaign to force immediate repeal.
“We anticipate that the mainstream media will dismiss this House vote as merely ‘symbolic’ because of resistance by the Democratic majority in the Senate,” said Hoagland. “Far from it, we will make sure that this vote is not ‘symbolic’ but the first step in our tough battle to make our elected officials actually represent the wishes of their constituents. There are many Senators who will be looking for other work if they ignore the legitimate demand of Americans to repeal it now,” said Hoagland.
News reports may cover the first of many petition deliveries and other grassroots advocacy tactics planned for coming months. “We will keep turning up the heat, degree by degree, until we see this destructive bill -- and insult to our democratic process -- erased from the books,” said Hoagland.

I wonder how many actual signatures that amounts to? Need to find that information out.
But, way to go Americans! Nice to see that "We the People" do, in fact, have a voice after all.

Time to Consider an Amendment to the U.S. Constitution?
Bravo, 112th Congress ... I'd say that you are off to a brilliant start! I have to admit, I did rather enjoy seeing Nancy Peolosi reciting her part of the U.S. Constitution earlier today ... To me, it was rather like seeing a repentant parochial school girl who had just gotten caught cheating come clean. So perhaps there is a modicum of justice in the world after all?
Another reason for auplause: a "yeah or nay" vote for the repeal of the "Healthcare Reform law" is on the agenda, in the House, in the upcoming week. Experts say it is unlikely that a similar vote will pass in the U.S. Senate -- although it should, if the elected officials in that chamber of the legislature have any hope of being re-elected to office --but I still keep hope. I mean, if the totally unthinkable can happen ... with this nightmare piece of legislation being signed into law against the will (and strong oposition!!) of the American people in the first place ... then why can't the also unlikely scenario of a repeal vote passing in the Senate occur?
If the above were to happen, that is that a repeal of the "Healthcare Reform" law were to pass in both the House as well as the Senate --despite what "experts" predict -- and such a bill were to make its way to President Obama for signature: he would be a fool NOT to sign it into law! ... Because, does President Obama really want to be remembered throughout history as the President whose party so grossly violated their constitutional mandate, forcing into law a bill to which the American people were so adamently opposed? I would hope not.
If the above scenario does not happen ... that is that is that a vote to repeal "Healthcare Reform" law passes in the U.S. House of Representatives, but not in the U.S. Senate ... then what are the American people supposed to do? Just swallow this horrible pill and accept the socialization of the American healthcare system? Standing by, helpless to act, as our healthcare system quality and available options decline, degrading the overall system, bit by bit, as we have seen socialized medicine do in European countries such as England? Not to mention the enormous cost of this snowball piece of legislation? Should "We the people" patiently wait while the constitutionality of this "law" is hammered out in the U.S. courts, in a long and drawn out process that will likely take longer than two additional years (as it is highly unlikely that this matter will be "fast tracked' through the court system and make its way to the U.S. Suprem Court in a timely manner)? I think NOT!! In this case scenario, I say that "We the People" do not wait two additional years to get justice: the damage that can be done in this timeframe is too great and I do not think that this damage can be averted by simply attempting to "defund" parts of the "Healthcare Reform" law. I say that we need to seriously consider the enactment of legislation that would create an amendment to the U.S. Constitution, whereby gross violations of legislative power (e.g., the passage into law of the "Healtcare Reform Act") can be redressed by a vote of the American people.
Perhaps it is fitting that I come to this epiphany ... a vocalization of this epiphany ... today, on the "Feast of the Epiphany"?
P.S. Bill Oreilly ... I am disappointed in you. You've tried so hard, for so long, to be in the "No Spin Zone" that you've apparently lost your momentum? If you were truly "fair and balanced" you would have Mike Huckabee, spokesperson for the "Petition to Repeal Healthcare Reform Law", on your television show ("The Factor") before you threw in the towel on the likelihood of a timely success for the repeal of the "Healthcare Reform law."

The Repeal It Now! Campaign to erase the disastrous HealthCare law is off to a red-hot start. Even in its first few weeks, the campaign has produced overwhelming results. Americans from coast to coast have responded strongly to television ads calling for outright repeal of the HealthCare Act. "We are well on our way to our first million petitions," said campaign chairman, Ken Hoagland.
"Mike Huckabee, Michael Reagan and even Joe the Plumber have helped us gather a growing momentum that will inevitably result in outright repeal of this destructive law in the coming year," said Hoagland. "We will use the largest petition drive in the history of the nation and a variety of overwhelming grassroots and legislative tactics to force a veto-proof vote for repeal in the coming months," he said.
"Because Congress forced this law down our throats over the objections of a majority of Americans it is only right that the American people answer back with an overwhelming demand for repeal," said Hoagland. "The many destructive realities of the new law have already begun to damage the fabric of American society and our economy and are fuel for the fire that now burns in the American people for outright repeal of this destructive legislation," he said.
The Repeal It Now campaign announced its first petition delivery will be in January to greet the incoming Congress. "There must be no mistake by Congress that the American people are determined to see this law overturned," said Hoagland. White House Friends Get Hundreds of ObamaCare Waivers
The White House has quietly granted more than 200 waivers for new healthcare act requirements, essentially granting repeal to more than a million people. For average Americans, however, only outright repeal through our campaign will bring relief from this destructive law.
Unions like the Service Employee's International Union (SEIU), perhaps the most partisan of all Mr. Obama's supporters (who devoted millions of dollars to attacking Republican candidates), was one of the first waivers granted -- allowing their members an "escape hatch" from ObamaCare. All unions were granted exemption from income taxes on the value of high cost plans -- unlike every other American.
Adding salt to the wound, the law exempts the President, Vice-President, cabinet officers and Capitol Hill staffers who work for Congressional Committees, among others.
The promise repeated over and over again that average Americans could keep their health care coverage has now been admitted to be false with the Administration itself conceding that as many of eight out of ten existing programs will disappear under onerous new coverage requirements.

The Repeal It Now! Campaign to erase the disastrous HealthCare law is off to a red-hot start. Even in its first few weeks, the campaign has produced overwhelming results. Americans from coast to coast have responded strongly to television ads calling for outright repeal of the HealthCare Act. "We are well on our way to our first million petitions," said campaign chairman, Ken Hoagland.
"Mike Huckabee, Michael Reagan and even Joe the Plumber have helped us gather a growing momentum that will inevitably result in outright repeal of this destructive law in the coming year," said Hoagland. "We will use the largest petition drive in the history of the nation and a variety of overwhelming grassroots and legislative tactics to force a veto-proof vote for repeal in the coming months," he said.
"Because Congress forced this law down our throats over the objections of a majority of Americans it is only right that the American people answer back with an overwhelming demand for repeal," said Hoagland. "The many destructive realities of the new law have already begun to damage the fabric of American society and our economy and are fuel for the fire that now burns in the American people for outright repeal of this destructive legislation," he said.
The Repeal It Now campaign announced its first petition delivery will be in January to greet the incoming Congress. "There must be no mistake by Congress that the American people are determined to see this law overturned," said Hoagland.
